( 2 ) - Definitions Section : Terminology

To ensure clarity and mutual understanding, the following key terms and definitions are provided as part of the Animal Purchase Agreement & Adoption Process Contract. These definitions apply throughout the document unless otherwise specified:

  1. Exotic Pet

    Refers to any animal that is not commonly kept as a domestic pet, including but not limited to species sourced, bred, or sold by Absolute Exotics SA. Examples include marmoset monkeys, capuchin monkeys, fennec foxes, wolves, and reptiles.

  2. Client

    Refers to the individual or entity entering into this agreement with Absolute Exotics SA for the purchase or adoption of an exotic pet. This includes all responsibilities, obligations, and rights outlined in the contract.

  3. Adoption

    Refers to the process through which the client formally agrees to take ownership of an exotic pet from Absolute Exotics SA, following the completion of the 5-step adoption process, payment of all applicable fees, and adherence to specified terms and conditions.

  4. Purchase Agreement

    A legally binding document that outlines the terms and conditions of the sale or adoption of an exotic pet, including payment terms, client responsibilities, and other relevant provisions.

  5. Animal Health Certificate

    A document issued by a third-party veterinarian specializing in exotic animals, certifying the health and wellness of the animal at the time of adoption. This certificate is standard for animals valued at R20,000 or more and may be provided for animals valued below R20,000 at the discretion of Absolute Exotics SA.

  6. Ownership Transfer

    The official transfer of legal ownership of the animal from Absolute Exotics SA to the client, which occurs upon the completion of all payments, training sessions, and adoption procedures.

  7. Breeding Restrictions

    Limitations imposed by Absolute Exotics SA on the breeding of any adopted or purchased exotic pet, requiring prior written authorization to ensure ethical practices and compliance with legal regulations.

  8. Permit Requirements

    Refers to the legal documentation necessary for the ownership, transport, or breeding of specific exotic animals, as required by South African national laws, provincial laws, and municipal bylaws. Clients are responsible for obtaining and maintaining such permits.

  9. Indemnity Clause

    A provision in this agreement whereby the client agrees to release and hold harmless Absolute Exotics SA from any claims, losses, or damages arising from ownership, care, or use of the exotic pet after the transfer of ownership.

  10. Starter Kit

    A package provided with each exotic pet, which may include essential items such as food, feeding equipment, blankets, toys, or other care-related items to assist the client during the initial care phase.

  11. After Service Assistance

    Ongoing support provided by Absolute Exotics SA to clients after adoption, including access to care guides, emergency helplines, private WhatsApp groups, and client events.

  12. General Care and Basic Behavior Training

    Mandatory in-person training sessions provided by Absolute Exotics SA to prepare clients for the responsibilities of exotic pet ownership, covering topics such as feeding, enclosure setup, and behavioral management.

  13. Veterinary Responsibilities

    Refers to the obligations of the client to provide routine and emergency veterinary care for the exotic pet, as outlined in this agreement, including but not limited to initial health checks and annual examinations.

  14. Deposit

    A non-refundable amount paid by the client to secure the adoption or purchase of an exotic pet. The deposit is applied toward the total purchase price and is required to initiate the sourcing or reservation of the animal.

  15. Digital Signature

    The client’s acknowledgment and acceptance of the agreement, indicated through actions such as completing the deposit payment or submitting the required documentation. This is recognized under the Electronic Communications and Transactions Act (ECTA) in South Africa.

  16. Animal Monitoring Period

    A 72-hour observation period conducted by Absolute Exotics SA before the animal’s final transfer to ensure its health, readiness, and proper transition to a suitable diet.

  17. Sourcing Process

    The process undertaken by Absolute Exotics SA to locate and prepare an exotic pet for adoption, following receipt of the client’s deposit and compliance with terms.

  18. Client Membership

    Exclusive membership granted to clients upon adoption, providing access to services such as the 24/7 emergency helpline, private WhatsApp groups, and invitations to annual owner and animal social events.

  19. Care Guides

    Detailed instructions and resources provided by Absolute Exotics SA to educate clients on the specific needs, dietary requirements, and behavioral traits of their adopted exotic pet.

  20. Seizure of Animal

    The legal right of Absolute Exotics SA to reclaim an exotic pet in cases where the client fails to meet the terms of the agreement, such as veterinary care requirements, breeding restrictions, or animal welfare standards.

  21. Permit Compliance

    The client’s responsibility to obtain and maintain all required permits and documentation related to the ownership and transportation of their exotic pet, ensuring adherence to South African laws and regulations.

  22. Indemnity

    The client’s agreement to protect Absolute Exotics SA from legal claims, damages, or losses arising from the ownership, care, or use of the exotic pet once ownership has been transferred.

  23. Third-Party Veterinarian

    A qualified veterinarian, independent of Absolute Exotics SA, who conducts health checks and provides certification for animals as required by the terms of the agreement.

  24. Educational Support Services

    Resources, such as training sessions, care guides, and client support channels, offered by Absolute Exotics SA to educate clients on the responsibilities of exotic pet ownership.

  25. Transfer of Risk

    The point at which all risks associated with the exotic pet (including health, behavior, and care) are transferred to the client. This occurs upon completion of payment and the pet leaving Absolute Exotics SA’s premises.

This Definitions Section ensures a shared understanding of key terms, providing a clear foundation for all aspects of the Animal Purchase Agreement & Adoption Process Contract. It supports transparency, accountability, and legal clarity for both Absolute Exotics SA and the client.

( 3 ) - Introduction to Terms of Service

This document serves as a legally binding contract between Absolute Exotics SA ("we," "us," or "our") and the client identified below.

By completing this digital form and agreement and providing Absolute Exotics SA with the requested information, you acknowledge that this is a legally binding contract. By paying the deposit, you confirm your acceptance of all terms and conditions outlined in this Animal Purchase Agreement, as well as any additional Terms of Service established by Absolute Exotics SA.

These terms govern all services and transactions conducted with us, including but not limited to the purchase of exotic animals or livestock. If you do not agree to all terms and conditions, you may not engage in any purchases or services with Absolute Exotics SA.

Absolute Exotics SA reserves the right to modify or update these terms at any time. These Terms of Service apply to all clients and users, including purchasers and site visitors, and remain enforceable throughout your engagement with Absolute Exotics SA.

5 Step Adoption Process

STEP 1:

Schedule a FREE Exotic Pet Consultation

Your adoption journey begins with a free Exotic Pet Consultation either remotely or in-person

where we discuss care needs and responsibilities for exotic pets. You’ll gain insights into the risks, requirements, and personalities of our animals, helping you make an informed decision.

WHY STEP 1 IS IMPORTANT:

This step ensures you’re well-prepared to care for your exotic pet responsibly, reducing the chance of future rehoming or surrender.

STEP 2:

Client Information, Purchase Agreement & Booking Deposit

Once you’ve made the decision to adopt, you will complete a personal information form and receive a proforma invoice along with the purchase agreement. This document outlines all terms and conditions, providing full transparency about the adoption process.

To secure your adoption, we require a R2500 deposit for animals valued up to R10,000. For animals with a purchase price/value over R10,000, we require a 35% deposit of the total amount as per the invoice. This deposit is non-refundable.

Once the deposit reflects in our account, the sourcing process begins, typically taking one to three days. Depending on the species, the time for the animal to reach the appropriate adoption age may vary from one week to six weeks, with an average adoption turnaround of just one week.

This step secures your commitment, allowing us to promptly source your pet without delays.

STEP 3:

72-Hour Monitoring & Observation

Once your pet reaches the appropriate age and is ready for adoption, it will undergo a 72-hour health monitoring and observation period at our facility.

This phase ensures that the animal is in optimal health, and our team closely supervises its transition from mother’s milk to formula or regular diet. During this period, we will also create a personalized feeding chart tailored to the animal’s unique dietary needs.

WHY STEP 3 IS IMPORTANT:

Monitoring ensures your pet’s health and prepares it for a stable transition to your home.

STEP 4:

General Care and Basic Behaviour Training

Before finalizing the adoption, you will participate in a comprehensive care training session at our facility. This in-house session will equip you with the necessary skills and knowledge for the well-being of your exotic pet. Topics covered include hand-feeding techniques, dietary requirements, behavioural training, and enclosure setup.

The training is scheduled during the 72-hour monitoring period and must be completed at least one day before the final adoption. This step ensures that you are fully prepared to care for your new companion in a responsible and informed manner.

WHY STEP 4 IS IMPORTANT:

Training equips you to meet your pet’s needs from day one, fostering a strong, positive bond.

STEP 5:

Adoption Day and Pet Collection

After successfully completing the observation and training phases, your pet is ready for adoption. Before the final handover, all animals valued over R20 000 go for a general health check-up with a third-party veterinarian. The vet will conduct all necessary treatments and inoculations required for your pet’s species, and you will receive a medical certificate to confirm the pet’s optimal health.

Please note animals valued over R20 000 comes standard with a health certificate Animals valued below R20 000 might not receive a health certificate and is at the discretion of Absolute Exotics SA

On adoption day, you will collect your pet from the Absolute Exotics SA premises, and all outstanding payments must be settled in full at this time.

Our commitment to you doesn’t end on adoption day.

At Absolute Exotics SA, we offer After Service Assistance to provide ongoing support for all exotic pet owners.

Whether you have questions about your pet’s health, need behavioral guidance, or want to share your pet’s progress, our team is always here to assist.

We also provide access to care guides, emergency helplines, and additional services to ensure the long-term well-being of your exotic companion.

Absolute Exotics SA is the only exotic animal pet breeder in South Africa that follows a set standard 5-step adoption process. We’re also the only breeders that provide clients with the following documentation:

A) - A Detailed Purchase Agreement

B) - An Invoice for the animal purchase

C) - Proof of Animal's Origin

D) - Proof of Ownership

A STARTER KIT

The Starter pack / kit includes everything you need to get started: and may contain the following products

feed, milk bottles, blankets, toys,

even a pet carrier, and a heating pad if the baby requires it.

GENERAL CARE & BASIC BEHAVIOR TRAINING:

We require all clients to attend an in-person training session at our offices where clients get to meet their new pet and do hands-on training with the animal.

This ensures that clients know exactly what the baby’s needs and requirements are, and they know how to correctly feed and care for the animal.

( 4 )

A COMPLEMENTARY MEDICAL PET INSURANCE QUOTATION

We’ve joined forces with one of South Africa’s leading and most innovative insurance providers. Within a few days after an adoption has taken place, our clients receive a call for a telephonic consultation for medical pet insurance for their new exotic companion and pet.

AESA CLIENT MEMBERSHIP & AFTER-SALES SERVICE

When purchasing an animal through us, you get access not only to our 24/7 emergency helpline but also to our private clients-only WhatsApp groups (WA) and invites to our annual owners and animal socials/events.

VETERINARY HEALTH CERTIFICATE:

All Animals valued at R20 000 or more go for a general health check-up and receive a health certificate from a trained third-party vet that specializes in exotic animals. Standard with the animals Animals valued below R20 000 may sometimes receive a certificate but is not guaranteed

SECTION 3

Payment Terms

( 1 )

Deposit and Administration Fee

Absolute Exotics SA requires a non-refundable deposit and administration fee, which is deducted from the final purchase price. The deposit structure is as follows:

  • R2500.00 for animals valued up to R10,000.
  • 35% of the total value for animals valued over R10,000.

For example:

If the total purchase price of an animal is R10,000, a deposit of R2,500 is required. Once this deposit is paid, the remaining balance due is R7,500.

The deposit must successfully reflect in Absolute Exotics SA’s bank account before the animal is reserved and the adoption process can proceed.

Purpose of Deposit

The deposit serves as a booking fee to secure the adoption and ensure the client collects the animal as agreed. While non-refundable, this amount is applied to the final purchase price.

( 3 )

Total Purchase Amount Due

The total purchase price is specified in the attached invoice. The remaining balance, after deducting the deposit, must be paid in full either prior to or on the day of collection.

( 4 )

Payment Methods

Payments can be made via EFT (Electronic Funds Transfer) to the banking details provided on the invoice.

( 5 )

Late Payment and Collection Penalties

Failure to collect the animal or settle the remaining balance within the agreed timeline will result in the forfeiture of the deposit and cancellation of the adoption. Absolute Exotics SA reserves the right to reallocate the animal to another client if the process is not completed as agreed.

( 6 )

No Guarantee & Refund Policy

Absolute Exotics SA maintains a strict no-guarantee and no-refund policy for all animals, species, and livestock purchased. Under no circumstances will Absolute Exotics SA be held liable for refunds, including but not limited to losses, damages, or death of the animal. This includes indirect or consequential losses, such as the loss of data or profits associated with the purchase or keeping of exotic animals.

Additionally, while Absolute Exotics SA strives to ensure accuracy in identifying the gender of exotic animals by having them assessed by licensed veterinarians, no guarantees are made regarding the animal's gender.

SECTION 4

Animal Health

Care Requirements

( 1 )

Pre-Adoption Veterinary Check:

For animals valued at R20,000 or more, a general health check-up will be conducted by a third-party veterinarian specializing in exotic animals. The client will receive a health certificate. For animals under R20,000, a health check-up may be provided at Absolute Exotics SA’s discretion. Health certificates are valid for 72 hours after the check-up.

Client's Ongoing Veterinary Responsibilities:

Clients are required to take the animal for a check-up within 3 to 6 months and provide Absolute Exotics SA with a digital copy of the medical report. After the initial check-up, clients must ensure annual veterinary care and submit digital proof of the check-up to Absolute Exotics SA.

Consequences for Failing to Provide Veterinary Care:

Failure to comply with veterinary requirements may result in seizure of animal

Sterilization and Microchipping:

Clients must sterilize the animal at sexual maturity unless otherwise agreed in writing. Animals must be microchipped by the time they reach adulthood (up to 2 years). Failure to comply may result in legal action.

SECTION 5

-Ownership Transfer

Ownership Transfer:

Ownership is transferred as soon as the animal leaves Absolute Exotics SA’s premises and all payments are completed.

( 2 )

Breeding Restrictions:

Clients are prohibited from breeding any animal purchased from Absolute Exotics SA without prior written authorization. Unauthorized breeding may result in seizure of the animal.

( 3 )

Permit Requirements:

Clients are responsible for verifying and obtaining any required transport and ownership permits for the animal in their province. Absolute Exotics SA is not liable for any legal issues arising from the client’s failure to comply with local regulations.

SECTION 6

Potential Risks,

Client Responsibilities,

and Indemnity Clause

( 1 )

Potential Risks:

If Absolute Exotics SA identifies a potential health or quality issue with the animal, the adoption process may be temporarily put on hold. Clients will be notified and issued a new invoice and collection date. If Absolute Exotics SA cannot supply an animal by the second scheduled collection date, the client may request a refund of the administration fee and booking deposit.

Client Responsibilities:

Clients must provide all required care for the animal, following Absolute Exotics SA’s care guides available online. Failure to follow the care instructions may result in legal action.

( 3 )

Indemnity Clause:

The client agrees to indemnify and hold harmless Absolute Exotics SA from any claims, losses, or damages arising from ownership of the animal. Absolute Exotics SA is not liable for any injuries or damages caused by the animal after the transfer of ownership.

SECTION 7

Governing Law:

This agreement is governed by all applicable South African national laws, provincial laws, and municipal bylaws, including the Animal Protection Act.

Dispute Resolution:

  • Informal Resolution:

    Parties will attempt informal discussions first.

  • Mediation:

    Mediation may be pursued if informal discussions fail.

  • Binding Arbitration:

    Disputes will be settled by binding arbitration under the rules of the South African Arbitration Association.

Enforcement of Breach of Animal Care Requirements:

Absolute Exotics SA will issue a legal notice via courier if a client is in breach of care requirements. The client has 5 working days to rectify the issue. Failure to comply may result in seizure of the animal and legal action. Clients will be responsible for all legal costs if found in breach of the agreement.

Client Acknowledgment and Liability for Legal Costs:

The client agrees to bear responsibility for all legal costs, attorney’s fees, and related expenses if found in breach of this agreement.

We strongly advise all clients to secure pet insurance for every exotic animal purchased through Absolute Exotics SA. Our collaboration with Dotsure.co.za highlights our innovative approach and dedication to ethical practices, compassion, integrity, and due care in all our operations.

Consent to Share Information and Communication Agreement

By electronically signing this agreement, you acknowledge and consent to the following terms:

SECTION 9

-Digital Signature

By submitting personal information to Absolute Exotics SA, accepting the issued invoice, and completing the deposit payment, the Client acknowledges and agrees that such payment constitutes their digital signature.

This action signifies the Client's acceptance of Absolute Exotics SA's Terms of Service, Terms & Conditions, Disclaimer Notice, and the Animal Purchase Agreement/Contract.

Note:

In South Africa, electronic signatures, including actions such as making a deposit payment, are legally recognized under the Electronic Communications and Transactions Act (ECTA). This Act stipulates that an electronic signature is valid if a method is used to identify the person and to indicate their approval of the information communicated, provided that the method was reliable and appropriate for the purposes for which the information was communicated
