Animal Purchase Agreement & Adoption Process Contract


This agreement is governed by the terms and conditions set forth by Absolute Exotics SA. Throughout this agreement, the terms “we,” “us,” and “our” refer to Absolute Exotics SA.

By engaging in any services or transactions with us, including the purchase of exotic animals or livestock, you agree to be bound by the following terms and conditions, as well as all additional Terms of Service set forth by Absolute Exotics SA. These Terms of Service apply to all clients and users, including, but not limited to, purchasers and site visitors.

By paying the deposit, you confirm your acceptance of all these Terms of Service outlined in the Animal Purchase Agreement. If you do not agree to all terms and conditions, you may not engage in any purchases or services with Absolute Exotics SA. Absolute Exotics SA reserves the right to modify or update these terms at any time.

Section 1: Our 5-Step Exotic Pet Adoption Process


At Absolute Exotics SA, we understand the importance of providing a structured and well-informed process when it comes to adopting exotic pets. We follow a comprehensive 5-step adoption process to ensure that both the client and the animal have a smooth and successful transition. Here’s how it works:


Step 1: Schedule a FREE Exotic Pet Consultation

The first step in our adoption process is an initial complimentary consultation. During this session at our Benoni A.H. office and showroom, our experienced team will discuss the unique care requirements and responsibilities that come with owning an exotic pet. You will gain essential knowledge regarding the risks, specific needs, and facts about the exotic animals available for adoption.

Whenever possible, you’ll also have the opportunity to meet some of our tame and fully-trained exotic animals to get a clear understanding of their size, handling requirements, and personalities. Our goal is to provide you with the insights needed to make an informed decision and choose the right pet for your home.

Why Step 1 is Important: This step equips potential pet owners with the knowledge necessary to make informed, responsible decisions. It helps prevent unsuitable adoptions by educating clients, thus reducing the likelihood of rehoming or surrendering pets due to behavioral issues. This step safeguards both the emotional well-being of the owner and the animal.


Step 2: Client Information, Purchase Agreement & Booking Deposit

Once you’ve made the decision to adopt, you will complete a personal information form and receive a proforma invoice along with the purchase agreement. This document outlines all terms and conditions, providing full transparency about the adoption process.

To secure your adoption, we require a R2500 deposit for animals valued up to R10,000. For animals with a purchase price/value over R10,000, we require a 35% deposit of the total amount as per the invoice. This deposit is non-refundable.

Once the deposit reflects in our account, the sourcing process begins, typically taking one to three days. Depending on the species, the time for the animal to reach the appropriate adoption age may vary from one week to six weeks, with an average adoption turnaround of just one week.

Why Step 2 is Important: This step tailors the adoption process to meet your specific needs and demonstrates your commitment to the adoption. It also ensures the timely sourcing of your new exotic pet, preventing delays or miscommunication during the adoption process.


Step 3: 72-Hour Monitoring & Observation

Once your pet reaches the appropriate age and is ready for adoption, it will undergo a 72-hour health monitoring and observation period at our facility. This phase ensures that the animal is in optimal health, and our team closely supervises its transition from mother’s milk to formula or regular diet. During this period, we will also create a personalized feeding chart tailored to the animal’s unique dietary needs.

Why Step 3 is Important: This critical step ensures that your new pet is in peak health before finalizing the adoption. It helps identify any hidden health issues, allowing for necessary interventions before the animal joins your household. The feeding plan provided will help establish a strong foundation for the pet’s well-being.


Step 4: General Care and Basic Behaviour Training

Before finalizing the adoption, you will participate in a comprehensive care training session at our facility. This in-house session will equip you with the necessary skills and knowledge for the well-being of your exotic pet. Topics covered include hand-feeding techniques, dietary requirements, behavioral training, and enclosure setup.

The training is scheduled during the 72-hour monitoring period and must be completed at least one day before the final adoption. This step ensures that you are fully prepared to care for your new companion in a responsible and informed manner.

Why Step 4 is Important: This step is crucial in preparing you to provide the best care for your exotic pet. It helps prevent issues arising from improper care, ensuring that the pet’s needs are met from day one and fostering a positive and lasting bond between you and your new companion.


Step 5: Adoption Day and Pet Collection

After successfully completing the observation and training phases, your pet is ready for adoption. Before the final handover, we arrange for a general health check-up with a third-party veterinarian. The vet will conduct all necessary treatments and inoculations required for your pet’s species, and you will receive a medical certificate to confirm the pet’s optimal health.

On adoption day, you will collect your pet from the Absolute Exotics SA premises, and all outstanding payments must be settled in full at this time.

Why Step 5 is Important: This final step ensures that the animal is healthy and ready for its new home. The secure transfer of ownership minimizes disruptions in the animal’s routine and well-being, making the transition smooth and stress-free for both the pet and the owner.


After Service Assistance

Our commitment to you doesn’t end on adoption day. At Absolute Exotics SA, we offer After Service Assistance to provide ongoing support for all exotic pet owners. Whether you have questions about your pet’s health, need behavioral guidance, or want to share your pet’s progress, our team is always here to assist. We also provide access to care guides, emergency helplines, and additional services to ensure the long-term well-being of your exotic companion.


Section 2: All Our Animals Come with the Following Included as Standard


PROOF OF ANIMAL PURCHASE, ORIGIN AND PROOF OF OWNERSHIP: Absolute Exotics SA is the only exotic animal pet breeder in South Africa that follows a set standard 5-step adoption process. We’re also the only breeders that provide clients with the following documentation:

  • A Detailed Purchase Agreement that includes:
    • An Invoice for the animal purchase
    • Proof of Animal's Origin
    • Proof of Ownership

A STARTER KIT: The kit includes everything you need to get started: feed, milk bottles, blankets, toys, even a pet carrier, and a heating pad if the baby requires it.

A VETERINARY HEALTH CERTIFICATE: All our babies go for a general health check-up and receive a certificate from a trained third-party vet that specializes in exotic animals just before adoption.

GENERAL CARE & BASIC BEHAVIOR TRAINING: We require all clients to attend an in-person training session at our offices where clients get to meet their new pet and do hands-on training with the animal. This ensures that clients know exactly what the baby’s needs and requirements are, and they know how to correctly feed and care for the animal.

A COMPLEMENTARY MEDICAL PET INSURANCE QUOTATION: We’ve joined forces with one of South Africa’s leading and most innovative insurance providers. Within a few days after an adoption has taken place, our clients receive a call for a telephonic consultation for medical pet insurance for their new exotic companion and pet.

AESA CLIENTS ONLY MEMBERSHIP AND AFTER-SALES SERVICE: When purchasing an animal through us, you get access not only to our 24/7 emergency helpline but also to our private clients-only WhatsApp groups (WA) and invites to our annual owners and animal socials/events.


Section 3: Payment Terms


The client fully understands and agrees to the fees and payment terms outlined below. Furthermore, by paying the deposit, the client acknowledges and accepts all other Terms & Conditions specified in this Animal Purchase Agreement.

1. Deposit and Administration Fee:

Absolute Exotics SA charges a non-refundable booking deposit and administration fee as follows:

  • R2500.00 for animals valued up to R10,000.
  • 35% of the total value for animals valued over R10,000.

This deposit must positively reflect in Absolute Exotics SA’s bank account before the animal is booked, and the adoption process continues.

2. Purpose of Deposit:

The deposit serves as a booking fee to ensure that the client collects the animal as agreed. No refunds will be issued,.

3. Total Purchase Amount Due:

The total amount is as specified in the attached invoice, and full payment of the remaining balance is required prior to or on the day of collection.

4. Payment Methods:

Accepted payment methods include EFT (Electronic Funds Transfer) to the specified banking details in the invoice.

5. Late Payment and Collection Penalties:

Failure to collect the animal or settle the balance will result in forfeiture of the deposit and cancellation of the adoption. Absolute Exotics SA reserves the right to reallocate the animal if the client fails to complete the process within the agreed timeline.

6. No Guarantee & Refund Policy:

Please note Absolute Exotics SA has a strict no guarantee & refund policy on all animals, species, and/or livestock purchased through ABSOLUTE EXOTICS SA. Under no circumstances will we be liable or responsible for refunding clients for any loss, damages, or death, including but not limited to indirect or consequential loss, damage, or death arising from the loss of data or profits in connection with the purchase and keeping of these exotic animals.

Additionally, there is no guarantee on the gender of any exotic animal. However, at Absolute Exotics SA, we make every effort to ensure the correct sex/gender by having each exotic animal checked by a licensed veterinarian.


Section 4: Animal Health and Veterinary Care Requirements


1. Pre-Adoption Veterinary Check:

For animals valued at R20,000 or more, a general health check-up will be conducted by a third-party veterinarian specializing in exotic animals. The client will receive a health certificate. For animals under R20,000, a health check-up may be provided at Absolute Exotics SA’s discretion. Health certificates are valid for 72 hours after the check-up.

2. Client's Ongoing Veterinary Responsibilities:

Clients are required to take the animal for a check-up within 3 to 6 months and provide Absolute Exotics SA with a digital copy of the medical report. After the initial check-up, clients must ensure annual veterinary care and submit digital proof of the check-up to Absolute Exotics SA.

3. Consequences for Failing to Provide Veterinary Care:

Failure to comply with the veterinary requirements may result in seizure of the animal.

4. Sterilization and Microchipping:

Clients must sterilize the animal at sexual maturity unless otherwise agreed in writing. Animals must be microchipped by the time they reach adulthood (up to 2 years). Failure to comply may result in legal action.


Section 5: Ownership Transfer, Breeding Restrictions, and Permit Requirements


1. Ownership Transfer:

Ownership is transferred as soon as the animal leaves Absolute Exotics SA’s premises and all payments are completed.

2. Breeding Restrictions:

Clients are prohibited from breeding any animal purchased from Absolute Exotics SA without prior written authorization. Unauthorized breeding may result in seizure of the animal.

3. Permit Requirements:

Clients are responsible for verifying and obtaining any required transport and ownership permits for the animal in their province. Absolute Exotics SA is not liable for any legal issues arising from the client’s failure to comply with local regulations.


Section 6: Potential Risks, Client Responsibilities, and Indemnity Clause


1. Potential Risks:

If Absolute Exotics SA identifies a potential health or quality issue with the animal, the adoption process may be temporarily put on hold. Clients will be notified and issued a new invoice and collection date. If Absolute Exotics SA cannot supply an animal by the second scheduled collection date, the client may request a refund of the administration fee and booking deposit.

2. Client Responsibilities:

Clients must provide all required care for the animal, following Absolute Exotics SA’s care guides available online. Failure to follow the care instructions may result in legal action.

3. Indemnity Clause:

The client agrees to indemnify and hold harmless Absolute Exotics SA from any claims, losses, or damages arising from ownership of the animal. Absolute Exotics SA is not liable for any injuries or damages caused by the animal after the transfer of ownership.


Section 7: Governing Law, Dispute Resolution, and Enforcement of Breach of Contract


1. Governing Law:

This agreement is governed by all applicable South African national laws, provincial laws, and municipal bylaws, including the Animal Protection Act.

2. Dispute Resolution:

  • Informal Resolution: Parties will attempt informal discussions first.
  • Mediation: Mediation may be pursued if informal discussions fail.
  • Binding Arbitration: Disputes will be settled by binding arbitration under the rules of the South African Arbitration Association.

3. Enforcement of Breach of Animal Care Requirements:

Absolute Exotics SA will issue a legal notice via courier if a client is in breach of care requirements. The client has 5 working days to rectify the issue. Failure to comply may result in seizure of the animal and legal action. Clients will be responsible for all legal costs if found in breach of the agreement.

4. Client Acknowledgment and Liability for Legal Costs:

The client agrees to bear responsibility for all legal costs, attorney’s fees, and related expenses if found in breach of this agreement.


Section 8: Digital Signature

By providing Absolute Exotics SA with personal information, accepting an invoice, and making the deposit payment, the client fully agrees and acknowledges that the deposit payment will be treated as their digital signature. By doing so, the client confirms their acceptance of Absolute Exotics SA’s Terms of Service, Terms & Conditions, Disclaimer Notice, and this Animal Purchase Agreement/Contract.
